»Conflicts of Interest in the Legal Profession. Criminal and Professional Law Risks, Exemptions and Reform Proposals«: The thesis addresses the problem area of conflicts of interest in the legal profession, in particular the criminal offence of betrayal of client under356 StGB and the prohibition against representing conflicting interests under43a(4) BRAO. The author develops a new, systematically sound concept of protected interests and a coherent, legally secure interpretation concept. Finally, reform proposals are evaluated and recommendations for a legislative redesign of the offence are formulated.; Der Autor behandelt das Problemfeld anwaltlicher Interessenkollisionen, insbesondere den strafrechtlichen Tatbestand des Parteiverrats nach356 StGB sowie das berufsrechtliche Verbot der Vertretung widerstreitender Interessen nach43a Abs. 4 BRAO. Beim Parteiverrat ist sowohl das geschützte Rechtsgut als auch die Auslegung nahezu aller Tatbestandsmerkmale in der Rechtsprechung und Literatur hoch umstritten. Vor diesem Hintergrund entwickelt die Arbeit eine neue, systematisch tragfähige Schutzgutkonzeption und erarbeitet ein in sich geschlossenes und rechtssicheres Konzept zur Auslegung des Tatbestands. Abschließend werden die in der Wissenschaft diskutierten Reformvorschläge untersucht und daraus konkrete Empfehlungen für eine gesetzgeberische Neugestaltung des Tatbestands des Parteiverrats abgeleitet.; Dissertationsschrift
